Chief Magistrate to rule on a no-case submission in ‘Que Pasa’ case

Chief Magistrate Sonya Young will rule on a no-case submission, put forward by the defence, when the matter concerning Antonio ‘Que Pasa’ Gellizeau, Bermudian Winston Robinson and Trinidadian Kent Andrews comes back up for hearing on January 16, 2012.{{more}}

The defence team, comprising of Trinidadian Theodore Guerra, St. Lucian Alberton Richelieu and Stephen Williams made a no-case submission in the matter on Friday, November 25 at the Serious Offences Court.

During the case on Friday, the defense recalled prosecution witness, Antonio Genchi, Italian businessman and managing director of JT Yachting SVG Ltd. for cross-examination.

Guerra, in an effort to bring Genchi’s credibility into question, spent a lengthy time during his cross-examination.

Chief Magistrate Sonya Young ordered the defence to present a written no-case submission by December 12, and that the crown should respond to the defence’s submissions by December 30.

Gellizeau is charged with concealing on the Yacht “Jotobin” on April 5, 2008, at Calliaqua, property of US$1,733,463 (EC$4,628,346), which in whole or in part, directly or indirectly, represents proceeds of criminal conduct. He is also charged with bringing the money into St. Vincent and the Grenadines on the yacht.

Both Andrews and Robinson were charged with concealing US$1,733,463 (EC$4,628,346) on the yacht Jotobin on April 5, 2008 at Calliaqua, knowing or suspecting or having reasonable grounds to suspect, in whole or in part, directly or indirectly, that the money represented another person’s proceeds of criminal conduct. They are also charged with bringing the money into St. Vincent and the Grenadines.

Winston Robinson was also charged with entering SVG without notifying the Comptroller of Customs of the intended time of arrival.

The crown, led by Senior Counsel Gilbert Patterson, Crown Counsel Sejilla McDowall and LaTeisha Sandy closed their case on Friday.
